Welcome to BookMyKahani. These Terms & Conditions (“Terms”) govern your access to and use of the BookMyKahani website (bookmykahani.com), services provided through the website, and services delivered via WhatsApp, Telegram or other messaging channels (collectively, the “Service”). By using or ordering any Service from BookMyKahani, you agree to these Terms. If you do not agree, please do not use our Service.

1. Who we are

BookMyKahani (“we”, “us”, “our”) provides text-to-audio and voice narration services, including free voice samples and paid custom audio production, delivered via our website and messaging channels such as WhatsApp and Telegram.

2. Acceptance of orders

You may request free samples or place paid orders by sending your script/story and instructions to our designated WhatsApp or Telegram contact or via the website order form.

All orders are accepted only after we confirm receipt and the agreed price/terms. Confirmation may be sent by WhatsApp, Telegram, email, or via the website. Until you receive confirmation, an order is not final and we may decline or request clarification.

We reserve the right to refuse any request for any reason, including content that violates these Terms or applicable law.

3. User responsibilities & representations

By submitting content or using the Service you represent and warrant that:

  • You are at least 18 years old (or have the legal capacity to enter into these Terms).
  • You own or have the necessary rights, licenses and permissions to submit the text, script, images, or other material (“Content”) and to permit us to use it for producing audio.
  • The Content does not infringe third-party rights, is not unlawful, defamatory, obscene, pornographic, hateful, threatening, or otherwise prohibited.
  • You will not submit personal confidential data (such as financial account numbers, passwords, health records) unless expressly instructed and arranged for secure handling.

If you submit Content on behalf of another person or organization, you confirm you have the right to do so and assume all responsibility.

4. How our Service works (summary)

  1. Send your script — Share your story or script on WhatsApp/Telegram or the website.
  2. We confirm & discuss — Our team will confirm details (voice choice, emotion, language, background music, delivery time, price).
  3. We produce & deliver — We create audio samples and send them back via WhatsApp/Telegram or other agreed channels. After your approval and payment (if applicable), we deliver the final audio file(s).

5. Pricing, payment & taxes

Pricing for paid services is provided at the time of order or via our pricing page. All prices are in the currency displayed during checkout.

Payments are processed via third-party payment gateways (e.g., Stripe, PayPal, Razorpay or similar). We do not store full payment card details. Payment processing is subject to the payment provider’s terms.

You are responsible for any applicable taxes, duties, or fees related to your purchase. If required by law, we may collect VAT/GST or similar taxes.

Orders are not started or delivered until payment is received where applicable.

6. Free samples, licensing & ownership

Free samples: Free voice samples are provided for preview only. Samples are not automatically licensed for commercial use unless explicitly stated.

License on paid orders: Upon full payment and completion of the order, we grant you a non-exclusive, worldwide, transferable license to use the delivered audio for the purposes agreed at the time of order (for example, YouTube videos, social media, podcasts, ads). Specific license terms (commercial vs non-commercial, exclusivity, sublicensing) will be set out at order confirmation if different from the standard license.

Ownership: You retain ownership of the original text/script you submit. We retain ownership of our underlying tools, models, templates, and any pre-existing material. The license grants you the right to use the final audio as set out above. If you need exclusive rights or other custom licensing, please contact us for a separate agreement.

7. Revisions & refunds

Revisions: Our standard order includes the number of revisions stated in the order confirmation. Additional revisions may incur extra charges.

Refunds: Free samples are non-refundable (they’re free). For paid orders, refunds are considered on a case-by-case basis:

  • If we fail to deliver the promised audio or deliverables and cannot remedy the issue within a reasonable time, you may be eligible for a partial or full refund.
  • If you request cancellation after work has started, refunds will be prorated depending on work completed.
  • We do not refund for dissatisfaction that falls within the scope of reasonable stylistic variations if we delivered according to the agreed specification and you used your right to revisions.

8. Content moderation & prohibited use

You agree not to use the Service to create audio that:

  • Promotes illegal activities, violence, hatred, or discrimination.
  • Defames, harasses, or invades the privacy of any person.
  • Violates intellectual property rights of third parties.
  • Impersonates a real person in a manner that would deceive, mislead, or defraud.
  • Contains adult sexual content involving minors.
  • Is otherwise unlawful or prohibited by these Terms.

We may refuse, remove, or block any content or order that violates these rules and may report illegal activity to authorities.

9. Delivery & technical limits

Delivery method (WhatsApp, Telegram, download link) and time estimates will be provided at order confirmation. Delivery times are estimates and may vary.

We are not responsible for delays caused by messaging platforms, network issues, or your own communication delays.

Large files or special formats may require additional handling or fees.

10. Warranties & disclaimers

We aim to provide high-quality, human-like voice output. However, we do not warrant that our audio will be perfect for every possible use or that it will meet every subjective expectation.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT WHERE PROHIBITED BY LAW.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKMYKAHANI (INCLUDING ITS AFFILIATES, EMPLOYEES, AND SUPPLIERS) SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
  • LOSS OF PROFITS, REVENUE, DATA OR BUSINESS; OR
  • ANY AMOUNT EXCEEDING THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow limitation of liability; where such laws apply, liability will be limited to the fullest extent allowed by law.

12. Indemnity

You agree to indemnify and hold BookMyKahani harmless from any claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys’ fees) arising from or related to:

  • Your breach of these Terms;
  • Your submission of Content that infringes third-party rights or is unlawful;
  • Your use of the delivered audio in a manner not authorized by these Terms or our license.

13. Privacy & data protection

Our Privacy Policy explains how we collect, use, and store personal data. By using the Service you agree to our Privacy Policy. See the Privacy Policy at https://bookmykahani.com/privacy (or the relevant URL).

14. Termination & suspension

We may suspend or terminate your access and refuse service at any time for violation of these Terms, illegal behavior, or conduct that may harm the business or other users.

You may stop using the Service at any time. Termination does not relieve you of unpaid fees or obligations incurred before termination.

On termination, licenses granted to you remain effective only for delivered and paid content unless otherwise agreed.

15. Changes to the Terms

We may update these Terms occasionally. When material changes occur, we will post the new Terms on our site with an updated “Last updated” date and may notify users. Continued use after changes means you accept the new Terms. If you do not agree with changes, stop using the Service and contact us.

16. Third-party services & links

We may integrate or use third-party services (payment processors, hosting providers, messaging platforms, analytics). Your use of these services is subject to their terms and privacy policies. We are not responsible for third-party actions or policies.

17. Intellectual property

The BookMyKahani name, logos, site content, and all underlying technology are our intellectual property or licensed to us. You may not use our trademarks without prior written permission.

You grant us a non-exclusive license to use the Content you submit to provide the Service (e.g., create and deliver audio), to improve services, and for quality assurance. We will not sell your original Content to third parties except as required to provide the Service or with your consent.

18. Governing law & dispute resolution

These Terms are governed by the laws of India. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India, unless otherwise required by applicable law. Before filing a formal claim, you and BookMyKahani agree to try to resolve disputes informally by contacting bookmykahani@gmail.com.

19. Miscellaneous

  • Severability: If any provision is invalid or unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any term is not a waiver of that term.
  • Assignment: We may assign these Terms or our rights and obligations to a successor; you may not assign your rights without our consent.
  • Force majeure: We are not responsible for failure or delay caused by events beyond our reasonable control (e.g., natural disasters, platform outages, strikes).
